TRADING TERMS

Postage and Packaging Service - Our standard Postal Packaging service of £1.75 applies to multiple orders of seeds dispatched throughout the world at one rate, however we reserve the right to contact you and advise an additional charge. Prices are generally advertised on the website for our items and may not reflect our standard rate whether they are a sundry item or special offer. Some items may not be available to post to all areas.

Payment - We accept payment orders through PayPal, Cheque, Postal Order or Cash all at own risk, however methods of payment can be limited due to location or regulation.

Prices - Prices are not subject to VAT. We reserve the right to revise any prices in the event of unforeseen circumstances or the appliance of VAT to our products during the time of order.

Order Acknowledgement - We will provide with your order details and aim to provide an estimated time of dispatch.

Order Dispatch - Orders are despatched promptly, normally within 48 hours of cleared payment by post or parcel carrier and are recorded with the appropriate postal service if applicable. Discrepancies of not receiving purchased items must be reported within 7 working days of cleared payment.

Alternatives - The supply of goods listed is subject to availability. If the order is not possible we will honor a full refund of payment upon request within 7 days of placing the order.

Seed Quality - Information given is to the best of our knowledge and is for general guidance only - please remember that environmental factors can affect plant growth. The germination and purity of all scheduled seeds comply with EU seeds legislation currently in force.

Customer Service - It is our aim to acknowledge complaints within 5 working days, and we will provide a likely timescale for resolving the dispute and keep you advised about progress.

Cancellation - Orders may be cancelled within 7 working days of being placed for a full refund. If goods have been dispatched, the Postage and Packing Service is non refundable. You have 7 working days from the date of receiving the goods to obtain full refund* but the you must arrange to return the item at your cost.

* Full refund after dispatch of products will exclude Postage and Package paid. Product must be returned as received accompanied with all packaging intact. This service does not apply to any form of live plants.

Exceptional Circumstance - Under certain conditions of products being returned with no prior agreement between the buyer and seller, hence no one in at time of delivery, or incorrect delivery address the buyer maybe liable to a re-administration of the Postage and Packing service of £1.75 or rates agreed on the initial contract whichever is greater in value.

Under no circumstances are we responsible for what the end user may utilise the products supplied through Seedstock.co.uk or its partners. It is in the responsibility of the end user to ensure the environment is suitable for the germination of this product. All pictures are for reference purposes. We reserve the right to make amendments without notice.

Your statutory rights are not affected by any of these business terms.

PRIVACY STATEMENT

We are strongly committed to protecting your privacy, we will only use relative information collected lawfully in accordance with the Data Protection Act 1998.

The information used is that to process orders at going time and update you with relevant information.

These Trading Terms apply to all goods supplied by Seedstock.co.uk

1.1 Any order placed by you for the goods advertised on Seedstock.co.uk.co.uk is an offer by you to purchase the goods selected in your order, we reserve the right to accept the order at the company�s discretion.

1.2 Due to system limitations an acceptance of order would be an acknowledgement mail indicating the order is being processed and/or has been dispatched.
1.3 If for any reason an order has not been accepted, if for example insufficient stock (without limitation) we will notify you by e-mail.

1.4 In the event that after we accept your order we discover that the goods ordered are unavailable or that there was a pricing error on our website in respect to the goods ordered, we reserve the right not to supply the goods ordered and to offer a full refund or alternative goods in accordance with section 2.*.

1.5 We have the right to terminate the contract if the full price of the goods or service ordered is not received in cleared funds (in accordance with section 2, 3).

1.6 Seedstock.co.uk may change the terms and conditions of sale without notice.

1.7 The contract is subject to the right of cancellation (see conditions 6.*)

2.1 The price and description of the goods and services you order will be shown on the Seedstock.co.uk website at the time you place your order, negotiation of additional discounts would be on a one to one basis (negotiation on bulk orders, service/product discounts at our discretion).

2.2 If after acceptance of your order we discover that all of your goods are unavailable, we may terminate the contract and refund you within 30 days for any sum that has been paid by you for the given goods. In these circumstances, we will inform you as soon as possible.

2.3 If after acceptance of your order we discover that some but not all of the goods ordered are unavailable, we will no longer supply those unavailable goods. In these circumstances we will contact you detailing the goods that are unavailable and offer you the option of cancelling the whole order or amending your order to substitute the unavailable items with alternative goods. If you have not cancelled the order within 7 days from indicated mail we will deliver the available goods in accordance with condition 4. We will refund or re-credit you for any sum that has been paid by you in respect to the unavailable goods or cancelled order .

2.4 Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. If within 7 days of your order a pricing error is found in respect of any or all of the goods or services you have ordered, we will notify you as soon as possible detailing the mis-priced goods, offering you the option of:
2.4.1) Placing a new order at the correct price for the goods/services;
2.4.2) Cancelling the whole of your order: or
2.4.3) Cancelling the order for the mispriced item(s) and reconfirming the order for the correctly priced goods/services.

If within 14 days of our notice to you have not responded by selecting one of the available options at conditions 2.4.1 to 2.4.3 above then:

(A) if all the goods you have ordered are found to be mis-priced the entire order will be cancelled automatically and the Seedstock.co.uk will refund or re-credit you will any sum you have paid for these goods; or
(B) if only some of the goods you have ordered are found to be mis-priced our contract with you continues and we will deliver the correctly price goods but will not be obliged to supply you with the mis-priced goods. In such circumstances we will refund you for any sum you have paid for the mis-priced goods

2.5) to avoid any confusion, where goods are unavailable and you order alternative goods from us, or where goods have been mispriced and you subsequently order such goods at the correct price, these terms of sale shall apply to the order and the supply of the relevant goods, whether the order is placed through our website or otherwise.

3.1 payment for the goods and delivery charges can be made by any method shown on our website at the time you place your order. In certain circumstances an additional charge maybe levied after an order is placed (i.e for an international cheque fee�s). Full payment shall be due before the delivery date and the prompt payment shall be as such fundamental to the terms of this agreement, breach of which shall entitle Seedstock.co.uk to terminate the contract at our discretion.

3.2 There will be no delivery made until funds received are cleared and paid full in any case.

4.1 The goods you order will be delivered to the address you gave when you placed the order unless by writing stated by you otherwise, some deliveries are not made outside the United Kingdom due to the limitations, risks or regulations involved, .

4.2 A working day is any day other than weekends and bank or other public holidays.
4.3 if delivery cannot be made to your address for reasons stipulated under this agreement, we will inform you as soon as possible.

4.4 if you deliberately fail to take delivery of the goods which have been made available, Seedstock.co.uk or delivery company may;
4.4.1 Store the goods until the next attempt may charge you for reasonable costs (including insurance and redelivery); or
4.4.2 Seedstock.co.uk to take the eventual receipt of the goods and issue a refund to you minus the service of delivery and other direct costs.

4.4 If you fail to take delivery because you have cancelled your contract under the distance selling regulations the Seedstock.co.uk shall refund or re-credit you within 30 days of any sum that has been paid by you all debited from your credit card for the goods. On exercising your right to cancel you as the customer shall be required to return the goods to the Seedstock.co.uk with a valid RMA number. Should you fail to return the goods by such appropriate means, the Seedstock.co.uk reserves the right to deduct any direct costs incurred by the Seedstock.co.uk in retrieving the goods as a result of such failure and may result in a delay in a refund.

4.5 Every effort will be made to deliver the goods as soon as possible after you order has been accepted. However, the Seedstock.co.uk will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In the case, the Seedstock.co.uk will try and inform you of any delay as soon as known possible and give you the option of cancelling your order at this point if the option is available.

5.1 The goods are at your risk after the delivery.

5.2 The product(s) will remain the property of Seedstock.co.uk as until full payment (in cleared funds) of all sums due.

6.1 You have the right to cancel the contract at any time up to 7 days after you receive the goods (see below). Please note that this policy has some limitations in terms of the product ordered, see below.

6.2 To exercise your right of cancellation, you must give written notice (written mail, email etc) to Seedstock.co.uk by giving details of the goods ordered and reasons of cancellation. Notification by phone or other means is not sufficient.

6.3 Except in the case of faulty or mis-described goods, if you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to the Seedstock.co.uk at your own cost. The goods must be returned to the address shown with a returns number (RMA) which is provided to you after a cancellation request is made (section 6.2).
You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. In the case of faulty or mis-described goods we shall ask you to return the goods to us in accordance with the Seedstock.co.uk returns procedure (see conditions 11.*).
6.4 Once you have notified the Seedstock.co.uk that you are cancelling the contract, the Seedstock.co.uk will refund or re-credit you within 30 days for any sum that has been paid by you for the goods after returned appropriately.

6.5 Except in the case of faulty or mis-described goods, if you do not return the goods as required we may charge you a sum not exceeding the direct costs of recovering the goods.

6.6 You do not have the right to cancel the contract if the order is for a perishable item (plants, seeds, customised goods etc), or for consumable goods which, by their nature, cannot be returned.

7.1 Goods supplied by us are warranted free from defects for 12 months from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer. If the item develops a defect during the 12 month warranty period, you should follow our returns procedure (see conditions 11 below). In the event of a valid claim for a defect in the new goods, where clauses 7.2, 7.3, 7.4 do not apply, we will (at option) either:
7.1.1 replace those goods, if Seedstock.co.uk has available the same goods at the same price;
7.1.2 repair those goods; or
7.1.3 refund or re-credit you the sum you have paid for the relevant goods excluding services within 30 days of the date that the relevant goods are returned in accordance with the Seedstock.co.uk's Returns procedure (see condition 11.* below).

7.2 The warranties in conditions 7.1 do not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence or repair by you or any third party, use otherwise than in accordance with its intended use, failure to follow the manufacturer's or Seedstock.co.uk�s instructions, or any alteration or repair carried out without the Seedstock.co.uk�s prior written approval.

7.3 If the goods supplied to you are damaged in transit, you should notify us in writing within 7 working days of receipt of the goods and return the goods with a valid RMA supplied to us in accordance with our returns policy (condition 11.*). Once we have verified the fault, we will issue you with (at your discretion) a replacement or full refund and reimburse your reasonable return carriage costs.

7.4 If the goods supplied to you are faulty or incomplete on arrival (whether or not they were damaged in transit), you must notify us within 7 calendar days of receipt of the goods and may need to return the goods to us in accordance with our returns policy. Once we have verified the fault, we will issue you with (at your discretion) a replacement or full refund via your original payment method and reimburse your reasonable return carriage costs.

8.1 Seedstock.co.uk shall not be liable to you for any loss or damage in circumstances where:
8.1.1 there is no breach of a legal duty owed to you by us;
8.1.2 such loss or damage is not a reasonably foreseeable result of any such breach;
8.1.3 any increase in loss or damage resulting from breach by you of any term of this contract.

8.2 Seedstock.co.uk shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement or product.
8.2.1 loss of business; loss of data; loss of profits; loss of goodwill; loss of anticipated savings or loss of revenue even when advised of the possibility; or
8.2.2 any indirect or consequential losses, liabilities or costs.

9.1 Seedstock.co.uk will take all reasonable precautions to keep the details of your order and payment secure but unless we as the Seedstock.co.uk are negligent, we will not be liable for unauthorised access to information supplied by you.

9.2
We will never need to ask you for personal information such as bank details and so forth. Such payment details are carried through third parties such as PayPal or other secure means. We do not store any bank details or such sensitive information on our database and any hard copies received may be archived or destroyed in accordance with the data protection act


10.1

Product images are for illustrative purposes only and may differ from the actual product.

11.1 In particular, please note that any items returned to us which you claim to be faulty or incomplete will be checked and verified by us. Any returned items that are found not to be faulty or incomplete will be returned to you after a charge you for the return carriage costs through namely your original payment method. In the event that your credit card has expired, or is declined we will hold the item(s) until full payment has been made for the return carriage.

11.2 Any items that you return to us are at your own risk, therefore we strongly advise all our customers to take reasonable care when returning any items to us for example, by ensuring the goods are correctly addressed, adequately packaged, sent via Royal Mail. Proof of postage is not proof of receipt.

11.3 No returns will be accepted without an authorised RMA number.

12.1
These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
